TERMS AND CONDITIONS

1. TRIAL PERIOD

You may try the Product(s) for the Trial Period specified above, beginning on the Trial Start Date.
The Trial Period cannot be extended without written consent from the Company.
You must either purchase the Product(s) or return them by 11:59 PM on the Trial End Date.
Open Box Discount: Because this chair is open box, electing to purchase this chair entitles you to a 20% discount off the price listed on outmoreliving.com at the time of purchase.
Purchase Intent: You can express your intent to purchase through email or phone, but it is not considered binding until written confirmation from an Outmore Living employee.

2. PAYMENT AUTHORIZATION

Payment Link: Outmore Living will send you a Stripe payment link for $50.00 to verify your payment method and pay for shipping costs.
Automatic Charge: Automatic charge will only occur after the trial period has ended, an unsuccessful pickup attempt, unsuccessful attempts to contact the customer, and written notice.

3. YOUR RESPONSIBILITIES DURING TRIAL

Care and Maintenance: You agree to use the Product(s) with reasonable care and follow all provided instructions and guidelines.
Risk of Loss: You bear all risk of loss, theft, damage, or destruction of the Product(s) during the Trial Period.
No Modifications: You may not modify, alter, or repair the Product(s) without written permission.
Outdoor Use: You acknowledge that while these are outdoor furniture products, you are responsible for protecting them from extreme weather conditions during the trial.

4. PRODUCT RETURN

Return Condition: Product(s) must be returned in substantially the same condition as received, accounting for reasonable wear from normal use.

Delivery and Pickup: Delivery and pickup will occur free of charge. Outmore Living will use various third parties for this service.

Packaging: Product(s) must be properly packaged to prevent damage during return shipping.

Return Confirmation: We will send email confirmation once we receive and inspect the returned Product(s).

5. PURCHASE OPTION

Early Purchase: You may purchase the Product(s) at any time during the Trial Period at the Retail Value.

Purchase Confirmation: If you decide to keep the Product(s), notify us before the Trial End Date to process your purchase.

6. FEES AND CHARGES

Damage Fee: If Product(s) are returned damaged beyond reasonable wear, you will be charged for repairs or replacement at our discretion.

Missing Items: You will be charged the full Retail Value for any Product(s) or accessories not returned.

Late Return Fee: Returns received after the Trial End Date may incur a late fee of $25 per day, not to exceed the Retail Value.

7. CANCELLATION

By Customer: You may cancel this trial by returning the Product(s) within the Trial Period.

By Company: We reserve the right to cancel this trial and request immediate return of Product(s) if you breach this Agreement.

8. LIMITED WARRANTY DURING TRIAL

Product(s) are provided "as is" during the trial period.

We will replace or repair defective Product(s) during the trial at no cost to you.

This limited warranty does not cover damage from misuse, accidents, or normal wear.

9. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE PRODUCT(S) DURING THE TRIAL PERIOD.

10. INDEMNIFICATION

You agree to indemnify and hold harmless the Company from any claims, damages, or expenses arising from your use, misuse, or possession of the Product(s) during the Trial Period.

11. PRIVACY

We will handle your personal information in accordance with our Privacy Policy, available at https://outmoreliving.com/policies/privacypolicy.

12. GOVERNING LAW

This Agreement shall be governed by the laws of Texas, without regard to conflict of law principles.

13. ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between the parties regarding the Try Before You Buy program and supersedes all prior agreements and understandings.
